A man in Manhattan is filing a lawsuit against Bally’s Fitness gyms after he slipped and fell on a “foreign white substance,” fracturing his shoulder. His lawsuit claims that cruising is to blame for this and it is prevalent across the country.
Marc Moskowitz fractured his shoulder in the steam room at his local Bally Total Fitness and insists that the managers knew that gay men had been performing “lewd behavior” in the steam rooms and sauna. According to NYDaily News, Moskowitz’s blames “aforementioned activities [for] [the] bodily fluids and other evidence of sexual activity wherever it occurred throughout the gym.” And despite him insisting that workers knew full-well that these sexual activities were occurring at the gym regularly, as a regular customer of Bally Total Fitness, Moskowitz claims he “didn’t know about it,” because he is not “involved in that lifestyle.” He likely thought that all of the offers he was receiving from men for “extra time” in the showers was just a perk of being a Bally member.
Unfortunately, his lawsuit fails to recognize the gym’s signage that thoroughly warns visitors to “wipe down machines after use,” whether that machine be a treadmill, a sauna floor or a 34-year-old accountant with irrepressible urges. Plus, this “foreign white substance” could have been lotion or foot cream, but seeing as Moskowitz made it a point to describe the substance as “foreign” it is likely to be some liquefied variant of anthrax, which makes it a national security problem, anyhow.
